North Texas Lawyers Defend Drug Crimes in Denton and Flower Mound

Steadfast representation for accused clients facing zealous prosecution

Texas drug laws are among the strictest in the country, even when it comes to small amounts of marijuana. If you are caught with a controlled substance, the potential consequences are severe, especially if there is sufficient weight to charge you with more than simple possession. With your future at stake, you need the highly professional and determined criminal defense representation we provide at Hayes, Berry, White & Vanzant, LLP. Drawing on decades of combined experience, our seasoned trial lawyers take affirmative steps to protect your rights and minimize the consequences of your arrest.

Drug possession lawyers resolve serious charges

Our criminal defense lawyers have extensive experience with a variety of Texas drug charges, including:

  • Possession of a controlled substance — Depending on the type of drug and the amount found, the minimum punishment is not more than 180 days in jail and a fine of up to $2,000 or both. The maximum punishment ranges from 10 years to life with a fine of up to $250,000.
  • Possession of marijuana — The minimum punishment for possession of a small amount of pot is not more than 180 days in jail and a fine of up to $2,000 or both. The maximum punishment ranges from five years to life in prison with a fine of up to $100,000.
  • Manufacture or delivery of a controlled substance — The minimum punishment is confinement in jail for a period of 180 days to two years and a maximum fine of $10,000. The maximum punishment is a prison term of 15 years to life and a fine of $250,000.
  • Delivery of marijuana — The minimum punishment is the same as for possession. The maximum punishment ranges from 10 years to life in prison with a fine of up to $100,000.
  • Driving while intoxicated — A DWI involving drugs can result in a jail term of 72 hours to 180 days and a fine of up to $2,000. The maximum punishment is imprisonment for two to 10 years and a fine of up to $10,000.

Under certain circumstances, federal drug charges are also possible. Considering the seriousness of the potential punishment, you must choose the best attorney available to manage your defense.

Defenses to drug possession charges in Texas

Depending on the circumstances, our attorneys may be able to use procedural challenges to fight the charges against you. For example, if you were the victim of an illegal traffic stop or an unreasonable search and seizure, drug evidence the police discovered would not be admissible in court.

There are also substantive defenses available in some cases. For example, a possession charge requires the accused to have “knowing” possession of the drugs. For example, if you did not know that drugs were in the car you were driving, you were not technically in possession. However, to be credible, such a defense must present a reasonable explanation as to how the drugs got into the car without your knowing about them. Having control over the drugs is another necessary element of possession. It is also possible to be in the presence of drugs but not to have control over them. Here again, there must be a credible explanation for the drugs, including the identity of the person who did exercise control over them.

When the facts are against you, our attorneys may still be able to deliver a favorable outcome by getting the charges reduced, obtaining lenient sentencing or avoiding jail time altogether with pretrial diversion, deferred prosecution or a first offender drug program designed to assist users rather than punish them.

When you retain our law firm for your drug possession defense, you get our full commitment to pursue the best outcome available.
