  • Manufacture or delivery of a controlled substance — The minimum punishment is confinement in jail for a period of 180 days to two years and a maximum fine of $10,000. The maximum punishment is a prison term of 15 years to life and a fine of $250,000.
  • Delivery of marijuana — The minimum punishment is the same as for possession. The maximum punishment ranges from 10 years to life in prison with a fine of up to $100,000.
  • Driving while intoxicated — A DWI involving drugs can result in a jail term of 72 hours to 180 days and a fine of up to $2,000. The maximum punishment is imprisonment for two to 10 years and a fine of up to $10,000.

Defenses to drug possession charges in Texas
