Hayes, Berry, White & Vanzant, LLP offers confidential, impartial and trustworthy mediation services for parties involved in multiple types of disputes. Our Denton, Texas attorneys draw on decades of experience in civil practice, so we understand the depth and breadth of issues in a range of legal areas. In addition, we are proficiently trained in the art of mediation. We help contesting parties reach objectively reasonable agreements that form the basis for mutually beneficial settlements.

What is mediation?

Mediation is a means of resolving disputes out of court in a confidential manner. The mediator is a neutral third party who guides the disputing parties to agreements via specialized communication and negotiation techniques.

Mediation has the following advantages over courtroom litigation:

  • Lower expense — Taking a dispute to trial escalates legal fees and other costs, which are in some cases out of proportion to the value of the conflict. Mediation is a much less expensive process.
  • Faster results — Crowded court calendars and the complexities of trial preparation can cause litigation to drag on and on. Mediation moves at the parties’ own pace.
  • Less combative atmosphere — While litigation is an adversarial process, mediation is cooperative. The goal is to find a reasonable compromise, not to defeat an opponent.
  • Privacy/confidentiality — A court case creates a public record of your dispute. Mediation is private, so outsiders are not privy to the details of your conflict.
  • Greater control over the outcome — In court, you may be subjected to an adverse ruling. But since mediation is voluntary, you are not obliged to accept terms you view as unfavorable or unfair.
  • Better at preserving parties’ relationships — Since mediation is cooperative, the process can actually repair personal or business relationships which the dispute has strained, thereby putting the parties on improved footing for future dealings.

For all of these reasons, parties to a civil dispute should consider mediation before committing to a costly court action.

  • Family lawDivorce mediation is often the best process for resolving matters of child support, child custody, visitation schedules, spousal support the division of property. A less adversarial atmosphere is beneficial for parties who must cooperate in co-parenting children after dissolving their marriage.
